EU Court Overturns Business Aviation’s Exclusion From Green Taxonomy
The European Union’s General Court has annulled the European Commission’s decision to exclude business aircraft manufacturing from the EU’s sustainable finance taxonomy, marking a significant legal victory for the business aviation sector. The ruling followed a challenge brought by Dassault Aviation and supported by the European Business Aviation Association.

The court found that the Commission had not adequately considered key factors, including the compatibility of business aircraft with Sustainable Aviation Fuel (SAF) and the unique operational role of business aviation. It also concluded that assessing aircraft solely on emissions per passenger kilometre was insufficient for determining the sustainability of manufacturing activities.

The ruling could improve access to sustainable finance for manufacturers and investors by removing the automatic exclusion from the EU’s green taxonomy. However, the European Commission may still appeal the decision, meaning the long-term regulatory outcome has yet to be finalised.
